I. Lewis "Scooter" Libby, convicted of perjury and obstruction of justice in the CIA leak case, was turned down by a federal judge in his request to stay out of prison pending appeal.
However, Libby's lawyers have said they will seek an emergency order from a federal appeals court delaying the sentencing.
According to the Associated Press:
Attorneys argue that, during trial, they were unfairly prohibited from discussing the classified issues that were weighing on Libby's mind at the time of the leak and from questioning witnesses that could have helped his case.
